These terms and conditions apply to the use of the website at westmidlandsfurniture.co.uk. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us.

Your status and placing orders

You are “The Customer” and by placing an order you confirm that you are legally capable of entering into binding contracts and you are at least 18 years old. 

Before you order

Before your order is placed please double check your order for sizes, finishes and colour. The order will be placed exactly as submitted. It is the customers responsibility to ensure the furniture fits in your desired place and you have enough access for the delivery of your items. The courier will need to be able to take your order into your property / threshold.

If the furniture does not fit, unfortunately this will be classed as a cancelled order and you will incur costs equal to the delivery charge. If free delivery was given, you may still be liable for a charge to cover our costs. You will also need to make sure the delivery van can make it close enough to your home.

Your Consumer Rights 

You may cancel the contract at any time within fourteen days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price you paid for the Products in accordance with our refunds policy.

To cancel the Contract, you must inform us in writing, by post to Unit 132-133 Anglesey Business Park Littleworth Road, Hednesford, WS12 1NR.  or by email to info@westmidlandsfurniture.co.uk.

You must also return the Product(s) to us at  Unit 132-133 Anglesey Business Park Littleworth Road, Hednesford, WS12 1NR within 14 days of notifying us in writing that you wish to cancel the contract, in a new and unused condition and in the original packaging, and at your own cost and risk.

Your refund will be in full and will be made within 14 days of us receiving the Products. You have a legal obligation to take reasonable care of the Products while they are in your possession.

Delivery & Collections

Delivery will be made to the address specified when you complete the order. You may alternatively choose, when ordering, to collect your Product(s) from our warehouses in Hednesford WS12 1NR during our business hours of 10am to 5pm, Monday to Friday.

These options are available at the time of order and therefore please select either “delivery” or “customer collection”.

We use a variety of delivery methods depending on the item and the speed with which you wish to receive it. For more information on our delivery arrangements and prices, please see our Delivery Information

Deliveries

We aim to fulfil your order by the approximate delivery date provided if no delivery date is specified, then within a reasonable time of the date of the, unless there are circumstances beyond our control which prevent us from doing so. In the event of our products being held up we shall contact you to let you know if we are having problems getting an item to you by the specified delivery date.

Delivery Arrival times are estimated and could change due to matters outside of West Midlands Furniture’s control. 

Collections

When collecting from our warehouse in Hednesford, it is the customer’s responsibility to check an item before signing for it and leaving the premises. Once the item has left our premises, we can not be held liable for any damage to the item

You can also send your own arranged transportation company to collect from us. When doing this, we need an email in advance from you confirming the name of the company who will be collecting. We also require that this is booked in with us (either by you, or your delivery company) so we can be prepared for the collection. We will then take a signature from the driver on collection. Whether it’s yourself or someone on your behalf, please understand that no claims can be made for damaged goods once the collection note has been signed.

Failed Deliveries

Any failure in delivery i.e. the customer is not present at the property on time of delivery will be classed as a failed attempt and a second delivery will need to be arranged and will result in an additional delivery cost. If the first missed delivery was a free of charge delivery a delivery fee will be added to the second attempted delivery. 

Delivery Disclaimer

Please be aware that although delivery teams take every care when delivering your new products, we cannot be held responsible for any damages that may occur to your property or possessions whilst the delivery is in progress. It is your responsibility to take every care to cover any carpets or furniture and remove any valuables and obstructions including pictures from the delivery area in case of any accidental damages especially when delivering larger, heavier furniture products.

Lead Times

The lead times are dependent on the availability of the items. All lead times given to the customer are estimates and not guaranteed. We ask customers to allow for longer delivery times during busy periods e.g. Christmas. We cannot be held liable for any delays outside our control. For any orders that go over the estimated delivery time the customer will be contacted via phone/email to be made aware of the delay.

Products & prices

Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely as possible those of the actual product due to technical limitations, some colours may vary.

Prices, product descriptions and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.

Any information displayed on our website(s) or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our website is updated regularly.

We reserve the right to alter our prices and specifications without notice.

Self Assembly Items

All self-assembly items / parts which are to be assembled by the customer must be thoroughly checked over before assembly is carried out failure to do so may create difficulty in completing the assembly which West Midlands Furniture cannot be held responsible for.
Any items that have been self-assembled by the customer and damaged in the process will result in charges to the customer for any spare parts/items required.
All items that are part / assembled by the customer which then require West Midlands Furniture to complete will be charged a call out and build fee.

Warranty

The majority of items come with a 12-month manufacturing warranty from the date of purchase. The warranty does not cover general wear and tear from everyday use and any item that has been modified by the customer. A third party may be called in from the products manufacturer to assess any complaints/ problems before a return/exchange or repair is carried out. In the case of any faults / faulty parts after the 12 months manufacturing warranty new parts will be chargeable to the customer.

Ownership of The Goods

The products/ furniture supplied by us become your property once we have received payment for them in full. Any outstanding balances will need to be paid for before delivery takes place.

Photography

The customer agrees that the company may use any photography for publicity purposes which include but are not limited to the company’s website and social media pages.

Returns & Refunds

If you wish to cancel your contract within the 14 days cooling off period, the item(s) must be in a new and resalable condition, with the original packaging. If required we can arrange for the item(s) to be collected with collection fees applicable.Please contact our customer services for more information.

All products will be fully inspected upon return and a refund issued less any return carriage costs due. All products shall remain the responsibility of purchaser until they are received at our warehouse.

When your item(s) arrives please check over it carefully before excepting and signing for the delivery. Once the delivery note is signed you are agreeing that the item(s) you have received aren’t faulty, damaged or incorrect. If after delivery you notice your item(s) are faulty please contact us as soon as possible with photos of the issue and we will help resolve the matter quickly and effectively.
